In Texas, Unemployment Insurance (UI) is a State program that pays compensation to qualified workers unemployed at no fault. The Texas Workforce Commission may pay benefits as help (temporarily), while unemployed residents look for a new job.


In order to qualify for benefits, claimants must meet certain eligibility requirements in 3 areas.

Claimants must meet all of the requirements in the three areas to receive benefits.

1. Claimant past salaray

To obtain benefits you must have a valid claim. A valid claim simply means you earned a specific salary amount during a recent 12-month period (referred to as base period). The base period is the first four of the last five completed calendar quarters before you applied for benefits. This means that when determine your benefits amount, we cannot use salaray in the calendar quarter in which you filed your claim, or the quarter prior. Your weekly benefit amounts are calcluated on the highest quarter earnings in your base period. Total quarter earnings are divided by 25 to determine your weekly benefit amount. Your weekly benefit amount is between $61 and $426 (dependent on the salaray you've previously) earned. The maximum benefit amount is either 26 times the weekly amount of benefits, or 27% of all previous salaray. Upon completion of applying for benefits, you'll receive a statement of your benefit amounts. Benefits are only paid to individuals with "valid" claims.

To have a valid claim you are required:

  1. Have earned salaray in at least 2 of your 4 base period quarters; and
  2. Have complete base period salaray that are at least 37 times weekly benefit amounts; and
  3. Earned 6x your new weekly benefits amount.

If the applicant were out of work for an extended period of time during the base period because of a medically verifiable illness, injury, pregnancy, or disability it is possible to use an alternate base period. Those who qualify under both a regular and an alternate base periods can decide which base period they want to use.

2. Your Termination from Previous Employment

Applicants can either be unemployed or partially unemployed (reduced hours) through no fault of your own to receive benefits.

Possible examples of qualifying reasons are:

  • Claimant was laid off due to lack of work.
  • Claimants are still working but the employer reduced your hours. (Your reduction in hours must not be because of a disciplinary action.)
  • Claimant was fired without work-related misconduct. Possible examples of misconduct are a violation of company policy; violation of law; neglect or mismanagement of your position; or failure to perform your work acceptably if you are capable of doing so.
  • Claimants quit your previous employment for a good well-documented work-related or medical reason. Claimants should be prepared to present evidence that you tried to correct the problem before you quit.
    TWC may rule good cause if the work situation would cause a person who truly wants to keep the job to leave it.
    • Possible examples of possible good cause are unsafe working conditions or a significant change in hiring agreement, or not receiving payment for your work.
    • Possible examples of medical reasons are not following on your doctor's advice, or quitting to care for a minor child, or quitting to care for a terminally ill spouse if there is no alternative care provider.
  • Claimants quit to protect themselves from family violence or stalking, evidenced by an active or recently issued protective order, a police record documenting family violence or stalking directed against the claimant,or medical documentation of family violence against you.

Applicants Please Note:

  • If the applicant quit to move in with a husband or wife, you may be able to receive benefits after found not eligible of 6 to 25 weeks. This is found not eligible of both time and money, because we must subtract the number of weeks from your total benefits.
  • If the applicant quit to move in with a military spouse, Texas lets you receive benefits without found not eligible if your spouse has a permanent change of station longer than 120 days, or a tour of duty longer than one year.

3. Ongoing availability and work search requirements

During each week you need compensation, you must:

  • Be actively search for full-time work, unless TWC excludes you from this requirement
  • Be physically able to work
  • Be available for full-time work
  • Apply for and accept suitable work
  • Call TWC, or call or report to a Workforce Solutions office, as instructed

The State will mail you a Statement of Benefits the next business day after you applied for benefits. The Statement of Benefits tells you:

  • The base period used for your compensation checks weekly;
  • The salary amount your employers reported paying you during each quarter of the base period; in addition to
  • Whether or not you earned enough for benefits qualification based on these salaray

If you earned enough money to qualify, it tells you the 12-month period your claim will be in effect, which is yourbenefit year. Your benefit year stays in effect for those dates even if you are disqualified or you receive all of your benefits. In other words, the money may run out before the year is over. The statement also gives your potential benefit amounts. The weekly benefit amount is the amount we can pay you for one full week of unemployment. Your maximum benefit amount is the total amount we can pay during your benefit year. Your weekly benefit amount will be between $61 and $426 depending upon the salaray you earned.

  • The salary amounts are listed in the quarter they were paid to the claimant, regardless of when you earned the money.
  • The law does not allow us to use some types of salaray to establish claims. Some examples are:
    • employment as an elected official
    • employment for a foreign government
    • employment for a religious organizatioon
    • employment for a family member
  • The claimant's Statement of Benefits won't not include salaray received from work for the federal government, military service, or work in other states. The State will send you an adjusted state when salary records are obtained.
